Collection and Use of Information Provided by Users of our Services
Information we may receive from third parties:We may receive information about you from third parties. For example, if you access our websites or Services through a third-party connection or log-in, for example, through Facebook Connect, by “following,” “liking,” adding an MPA Defence Industries Ltd application, linking your account to an MPA Defence Industries Ltd Services, etc., that third party may pass certain information about your use of its service to MPA Defence Industries Ltd. This information could include, but is not limited to, the user ID associated with your account (for example, your Facebook UID), an access token necessary to access that service, any information that you have permitted the third party to share with us, and any information you have made public in connection with that service. If you allow us access to your friends list, your friends’ user IDs, and your connection to those friends, may be used and stored to make your experience more social, and to allow you to invite your friends to use our Services as well as provide you with updates if and when your friends join an MPA Defence Industries Ltd Services. You should always review, and if necessary, adjust your privacy settings on third-party websites and services before linking or connecting them to an MPA Defence Industries Ltd Services. You may also unlink your third party account from our Services by adjusting your settings on the third party service.
Inviting a friend to use our Services:MPA Defence Industries Ltd may, in its sole discretion, develop a feature that allows you to invite third parties to their Services. If you choose to use our invitation service to invite a third party to our Services through our “Invite friends” feature, you may directly choose a friend to invite through your mobile device’s native contact list – but we do not require that you import your contacts list to our Services, and we do not retain the information contained in your contacts list. You understand that by inviting a friend to MPA Defence Industries Ltd through the “Invite friends” feature, you are directly sending a text or email from your personal accounts and that we are not storing your contact list. In addition, you understand and agree that normal carrier charges apply to communications sent from your phone. Since this invitation is coming directly from your email or phone, we do not have access to or control this communication.
Finding your friends on our Services:MPA Defence Industries Ltd may, in its sole discretion, develop a feature that allows you to locate your friends with MPA Defence Industries Ltd Services accounts through a “Find friends” feature. The “Find friends” feature allows you to choose to locate friends either through (i) your contact list, (ii) social media sites (such as Twitter or Facebook) or (iii) through a search of names and usernames on MPA Defence Industries Ltd. If you choose to find your friends through your contact list, then you agree to provide MPA Defence Industries Ltd access to your contact list such that we can perform the search necessary to determine whether or not someone associated with the information you provide is using MPA Defence Industries Ltd. If you choose to find your friends through social media sites, then you understand that the information these sites provide to use to conduct this type of search is governed by their privacy policies and your account settings on those sites. If you choose to find your friends through a search of names or usernames, then simply type a name to search and see if that name or username appears on our Services. Note that we do not retain any information contained in your contacts list, or information from social media sites about your contacts, and we do not use such information for any purpose other than to help you find your friends on MPA Defence Industries Ltd.
Analytics information:We may directly collect analytics data, or use third-party analytics tools and services, to help us measure traffic and usage trends for our Services. These tools collect information sent by your browser or mobile device, including the pages you visit and other information that assists us in improving our Services. Log file information:Log file information is automatically reported by your browser or mobile device each time you access our Services. When you use our Services, our servers automatically record certain log file information. These server logs may include anonymous information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on our Services, domain names, landing pages, pages viewed, and other such information.
Clear gifs/web beacons information:When you use our Services, we may employ clear gifs (also known as web beacons) which are used to anonymously track the online usage patterns of our Users. In addition, we may also use clear gifs in HTML-based emails sent to our users to track which emails are opened and which links are clicked by recipients. The information is allows for more accurate reporting and improvement of our Services.
Device identifiers:When you access our Services by or through a mobile device (including but not limited to smart-phones or tablets), we may access, collect, monitor and/or remotely store one or more “device identifiers,” such as a universally unique identifier (“UUID”). Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device. A device identifier may be data stored in connection with the device hardware, data stored in connection with the device’s operating system or other software, or data sent to the device by MPA Defence Industries Ltd. A device identifier may convey information to us about how you browse and use our Services. A device identifier may remain persistently on your device, to help you log in faster and enhance your navigation through our Services. We also use your information to send you Service-related emails (e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of our Services, technical and security notices). You may not opt out of Service-related emails. You may also be able to be “found” on MPA Defence Industries Ltd based on information that you provide (see “Find friends on MPA Defence Industries Ltd”) above.
What happens in the event of a change of control:We may buy or sell/divest/transfer the company (including any shares in the company), or any combination of its products, services, assets and/or businesses. Your information such as customer names and email addresses, User Content and other user information related to our Services may be among the items sold or otherwise transferred in these types of transactions. We may also sell, assign or otherwise transfer such information in the course of corporate divestitures, mergers, acquisitions, bankruptcies, dissolution’s, reorganisations, liquidations, similar transactions or proceedings involving all or a portion of the company.
Instances where we are required to share your information:MPA Defence Industries Ltd will disclose your information where required to do so by law or subpoena or if we reasonably believe that such action is necessary to (a) comply with the law and the reasonable requests of law enforcement; (b) to enforce our Terms and Conditions or to protect the security, quality or integrity of our Services; and/or (c) to exercise or protect the rights, property, or personal safety of MPA Defence Industries Ltd, our Users, or others. With regards to members of the club and Service Users who buy RIFs MPA Defence Industries Ltd are obliged under UK Law to fully cooperate and disclose information to the Police, the Home Office and the UK Boarders Agency if officially requested to do so.
Sharing certain service type information we collect about you:We may share certain service type information, including information obtained through tools such as cookies, log files, device identifiers, location data and clear gifs (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.): (i) with our third-party business partners for the purposes described in the section above on “How We Collect and Use Information.” We may also aggregate or otherwise strip data of all personally identifying characteristics and may share that aggregated, anonymized data with third parties.
How We Store and Protect Your Information
Keeping your information safe:MPA Defence Industries Ltd cares about the security of your information, and uses commercially reasonable safeguards to preserve the integrity and security of all information collected through our Services. To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from MPA Defence Industries Ltd, at all times. However, MPA Defence Industries Ltd cannot ensure or warrant the security of any information you transmit to MPA Defence Industries Ltd or guarantee that information on our Services may not be accessed, disclosed, altered, or destroyed. Your privacy settings may also be affected by changes to the functionality of third party sites and services that you add to the MPA Defence Industries Ltd Services, such as social networks. MPA Defence Industries Ltd is not responsible for the functionality or security measures of any third party.
Compromise of information:In the event that any information under our control is compromised as a result of a breach of security, MPA Defence Industries Ltd will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.
Your Choices about Your InformationYou control your account information and settings: You may update your account information and email-communication preferences at any time by logging in to your account and changing your profile settings. You can also stop receiving promotional email communications from us by logging into your account. We make every effort to promptly process all unsubscribe requests. As noted above, you may not opt out of Service-related communications (e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of our Services, technical and security notices). Opting out of collection of your information for Tracking / Advertising:Please refer to your mobile device or browser’s technical information for instructions on how to delete and disable cookies, and other tracking/recording tools. Depending on your type of device, it may not be possible to delete or disable tracking mechanisms on your mobile device. Note that disabling cookies and/or other tracking tools prevents MPA Defence Industries Ltd or its business partners from tracking your browser’s activities in relation to our Services, and for use in targeted advertising activities by third parties. However, doing so may disable many of the features available through our Services. How long we keep your private profile information:Following termination of your User account, MPA Defence Industries Ltd may retain your private profile information for a commercially reasonable time for backup, archival, or audit purposes. For the avoidance of doubt, any information that you choose to make public on the service may not be removable.
Children’s PrivacyMPA Defence Industries Ltd does not knowingly collect or solicit any information from anyone under the age of 13 or knowingly allow such persons to register as Users. Their Services and its content are not directed at children under the age of 13. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. Terms & Conditions
These terms and conditions are intended to define the rights and obligations of the parties in the sale of goods proposed online by THE MERCHANT for the customer.
All contractual information will be confirmed by email to the address specified by the customer during the purchasing act.
Proof of Transaction
The records stored in THE MERCHANT’s computer systems under reasonable safety conditions are considered proof of communications, orders and payments made between the parties.
Purchase orders and invoices are stored on a reliable and durable system and can be produced as evidence.
Every effort has been made to ensure the accuracy of the information presented on THE MERCHANT SITE. THE MERCHANT or its suppliers shall not be held liable for the consequences, accidents, or special damages arising from electronic transmissions or the accuracy of transmitted information, even in cases where THE MERCHANT was aware of the possibility of such damages. Manufacturer and brand names are only used for identification purposes. Product photos, descriptions and prices are non-contractual.
Validity Period of Offer and Prices
Our offers and prices are valid for the day the site is consulted and are subject to change without notice.
Products are delivered to the address specified by the customer on the purchase order and only to geographic zones that we service.
All products leave our premises in perfect condition. The customer must notify the carrier (or postman) of even the slightest trace of damage (holes, signs of crushing, etc.) to the parcel, and refuse the package if necessary. A new, identical product will then be sent to the customer at no additional charge.
No exchanges can be made at a later time for goods claiming to be damaged during carriage without notification at the time of reception.
As with any shipment, a delay or loss of goods is possible. In such a case, the carrier shall start an investigation. Every effort is made, for as long as necessary, to find the package. If the package is not found, the carrier will reimburse THE MERCHANT, who will deliver a new, identical package to the customer free of charge.
We shall not be held responsible for delayed delivery times due to the carrier, including for the loss of goods, bad weather or strikes.
Loss or Damage in Transit
THE MERCHANT will not be responsible for damage or loss of goods or part thereof in transit or for any discrepancy between the goods delivered and the goods ordered unless the customer gives written or email notice of a claim to THE MERCHANT and the carrier within three (3) business days of delivery.
In the event of damage of goods or part thereof in transit or for any discrepancy between the goods delivered and the goods ordered, the customer must hold the goods and make them available for inspection or collection by THE MERCHANT or its representatives on request.
The customer must inform THE MERCHANT immediately (the same day or, at the latest, the first business day following delivery) concerning any claim of delivery error or non-conformity of goods, in kind or in quality, compared with the information on the purchase order.
Any claim made after this time period will be rejected.
All claims must be made in writing and sent to THE MERCHANT ADDRESS.
Any claim that does not respect the rules defined above cannot be taken into account and releases THE MERCHANT of any responsibility to the customer.
In the case of delivery error or exchange, all goods to be exchanged or refunded must be returned to THE MERCHANT in whole, in its original packaging and in perfect condition to THE MERCHANT ADDRESS.
For claims to be accepted, the customer must first make a declaration to THE MERCHANT concerning any returns and receive and THE MERCHANT’s consent. If accepted, the customer will ship the package to THE MERCHANT ADDRESS.
Shipping fees shall be at THE MERCHANT’s expense, except in the case where the goods do not correspond to the original declaration made by the customer concerning the return.
The provisions hereof cannot deprive the customer of their right to legal warranty requiring THE MERCHANT to protect the customer against latent defects of goods sold.
The customer is expressly informed that THE MERCHANT is not the manufacturer of the goods presented in THE MERCHANT SITE and that THE MERCHANT shall not be held liable for defective goods.
In the case of damage to a person or property resulting from a product defect, only the product manufacturer shall be held liable and sought after by the customer, by means of the information provided on the packaging of said product.
All products sold on THE MERCHANT SITE are under a three (3) month to one (1) year warranty depending on the product. This warranty does not cover faults caused by accident, negligence, misuse or normal wear and tear and consumable items. All products that have been modified or repaired by the customer or any other party not chosen by THE MERCHANT are not covered by this warranty.
The warranty can be extended according to the terms provided in store and on the website.
All damaged deliveries or shortages must be reported within 24 hours of receipt.
Warranty periods for our products will apply for all items from the date of the purchase and are as follows:
12 months: AEG’s made by G&P, G&G and Tokyo Marui
6 months: any other AEG’s
3 months: Gas powered products (pistols, rifles, etc.)
3 months: rechargeable batteries, chargers and all engineering work
1 month: any other items not specified above
All or any issues must be reported within 24 hours of receipt.
In the unlikely event that a new purchase is faulty then the customer must contact THE MERCHANT immediately to discuss the problem. In the event that the product is indeed faulty and warrants a replacement, the original product must first be returned for inspection. Once an engineer confirms the fault, at THE MERCHANTS discretion a replacement may then be arranged.
No refunds or replacements will be given on any product that has been damaged by negligence, carelessness or misuse. In these cases, all warranty on the product is voided.
All refunds will have the original cost of postage and the cost of the refund (£1) deducted from them. The customer is responsible for return postage costs.
NO refunds can be issued on products that have been custom built to order or sprayed to order.
Right to Cancel
In accordance with the UK Laws, the customer has the right to cancel an order for goods starting from the moment they place their order and ending fourteen (14) days from the day they receive their goods and return said goods at their own expense, without having to give a reason. All returns can be indicated beforehand with THE MERCHANT customer service department. All goods must be returned to THE MERCHANT ADDRESS.
If an order consists of multiple goods, the 14 day period runs from when the customer receives the last of the batch.
This 14 day period is the time the customer has to decide whether to cancel, the customer then has a further 14 days to actually send the goods back.
The cooling off period and right to cancel do not apply to contracts, orders for any goods made to your specification (ie sprayed weapons), any downloaded goods or unsealed goods including but not limited to (DVD, CD, Tapes, Software, Video and audio) or skirmishes (see below).
Skirmishes: Skirmishes can be booked either online, by telephone or in person. Payments are non-refundable but can be transferred to another player on that night as long as the site is informed. If a skirmish is cancelled by MPA Enterprises Ltd, all pre-paid places will be refunded or transferred to an alternate night according to the player’s instructions.
Only complete and unused goods in perfect condition for resale will be accepted. No refunds or exchanges will be made for incomplete, damaged or unsealed goods, including damage to original packaging. The customer can exercise this right to withdraw without penalty, excepting the return fee for the goods. If the customer exercises the right to withdrawal, they have the option of requesting a full refund or exchange of goods. If an exchange is requested, all shipping expenses shall be the responsibility of the customer.
Unwanted weapons must be returned with a letter explaining the situation and must be, unopened, unused and in the original, undamaged packaging missing no items from the packaging including the complimentary packet of BB’s and the original invoice. If opened or used in anyway, the item cannot be returned.
If the right to withdrawal is exercised, THE MERCHANT will make every effort to refund the customer within 30 days.
Right of Use
The use of any trademarks, logos or brands present on the site is strictly forbidden.
Neither party will be deemed to be in breach of any of its obligations under the agreement as a result of any delay in performing or any failure to perform any such obligations by reason of any cause or event beyond the parties’ control. A force majeure event includes, but is not limited to, any unforeseeable, inevitable, or unstoppable act, event, non-happening, omission or accident beyond the control of either party, despite all reasonable efforts made to the contrary. In addition to events usually recognized by the British courts, a force majeure event includes in particular (without limitation) the following: Strike, lock-out, earthquake, fire, storm, flood, lightning, explosion, impossibility of the use of public or private telecommunications networks.
In such circumstances, the party delayed or unable to perform (“Delayed Party”) shall notify the other party (“Affected Party”) within ten (10) business days following the date such events become known.
Unless prevented due to force majeure, both parties will meet within three months to examine the impact of the event and agree to the conditions under which the contract shall be continued. If the force majeure lasts longer than one (1) month, this agreement may be terminated by the injured party.
These terms and conditions remain valid and in force, even if one or more clauses are invalid or declared so under any law, regulation or following the final decision of a competent court.
No failure of either party to exercise any power given to it in these terms and conditions or to insist upon strict compliance by the other party with its obligations hereunder shall constitute a waiver of either party’s right to demand exact compliance with the terms hereof.
All personal data you provide us is used to process your orders. This data will be treated in accordance with the Data Protection principles outlined in the Data Protection Act 1998.
Applicable Law and Competent Jurisdiction
In form and content, these Terms and Conditions shall be governed by and construed in accordance with English law. All orders placed on THE MERCHANT SITE strictly imply the acceptance of THE MERCHANT’s terms and conditions.
In case of dispute or claim, the customer agrees to seek an amicable solution with THE MERCHANT before proceeding with any legal action. In the event where such a solution cannot be found, any disputes concerning the sale (price, Terms and Conditions, products, etc.) will be subject to the exclusive jurisdiction of the English courts.
